When is it Too Late to Apply for a Disability Pension?

A common question which we frequently receive from our firefighter and police officer clients is when would be the best time to apply for a disability pension? The answer will often vary on a case-by-case basis. However, there is one important piece of advice which we tell all of our clients that should be followed without exception. The most important rule to keep in mind is that in order to be eligible to file for a disability pension, an Article III and Article IV first responder must still be employed by the municipality at the time of filing. Our Supreme Court has considered this issue and confirmed that a first responder is no longer eligible to file for a disability pension after their employment has been separated. So, generally, if a first responder has quit, resigned, retired, or been terminated prior to filing for a disability pension, the Board will be without jurisdiction to even consider the application, and the application will be dead no matter what the circumstances are regarding the underlying disability.
