We are happy to report another hard-fought victory before the Workers’ Compensation Commission on behalf of a client. We represent a worker who suffered a significant lower back injury as a result of a trip-and-fall accident at work. As a result of this accident, she was completely disabled from working, and her treating orthopedic physician recommended a spinal fusion surgery in her lower back. However, the insurance company refused to pay any disability benefits, and refused to authorize any necessary medical treatment. Instead, the insurance company hired an independent medical examiner to argue that our client’s injury was unrelated to her work accident given that there was an initial delay in her reporting for medical treatment for approximately 1 month. The insurance company argued that this delay in obtaining treatment meant that our client’s injuries were purely degenerative in nature and unrelated to any injury at work.
Given the insurance company’s refusal to pay, Brent Eames filed a request for an emergency hearing and pushed the case to trial. After trial, which included the testimony of our client’s treating doctor, as well as the insurance company’s retained expert, the Commission sided with our client on all issues and awarded all owed benefits. These benefits included over $35,000.00 in owed temporary disability benefits, and payment of all related medical expenses, including the lumbar fusion recommended by her treating surgeon.
